Why should I hire a trademark attorney?
Hiring a trademark attorney can ensure your application is properly handled from start to finish. An attorney can conduct a thorough trademark search to avoid conflicts, prepare a strong application to increase your chances of approval, and respond to any Patent & Trademark Office issues. An attorney can also help enforce your trademark rights and protect your brand as it grows. While hiring an attorney may cost more upfront, it saves you time, reduces legal risks, and offers long-term protection for your business.
When should I hire a trademark attorney?
ASAP. Legal issues can be overwhelming, and starting a new business comes with a lot of expenses. But the last thing you want to do is finalize a name without having a short chat with a trademark attorney who can help you make sure you're not headed for major trouble.
Should I form my business or file a trademark application first?
It depends. This is the entrepreneur's dilemma. Starting your business first allows you to get going and to start making money. But, starting your business often involves choosing a brand name. And choosing a brand name without a proper legal clearance search can set you up for increased risk of rebranding, legal conflicts, and other marketing setbacks. It's a tough decision, but there are at least two ways to address or minimize this problem, including (1) file a trademark application with an intent-to-use (ITU) basis before forming your business, or (2) conduct a preliminary trademark clearance search before forming your business. The preliminary search won't reserve your name, but it can help you uncover businesses with similar names and help you avoid choosing a name with obvious potential obstacles. I can help you with either approach.
How long can I wait before registering a trademark?
There's no clear answer to this question. It’s best to register your trademark as soon as possible after deciding on your brand name or logo. The longer you wait, the more you risk someone else claiming it, which could cost you time, money, and your brand identity.
